Terms of Service

These Terms of Service (“Terms”) govern your use of the Oui Smoke website and, where applicable, your booking of services from Oui Smoke Catering Inc. (“Oui Smoke,” “we,” “us,” or “our”). By using this site or requesting a booking, you agree to these Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
1. About our services
Oui Smoke provides premium hookah catering and related event services for private and corporate events, primarily in Toronto and the Greater Toronto Area, with travel by arrangement. Website content, package descriptions, calculator estimates, and pricing are for information only and do not guarantee availability.
2. Age requirement
You must be of legal age to use hookah/tobacco-related products in the jurisdiction of the event. In Ontario, that age is 19. By booking, you confirm that all guests who will use hookah services meet applicable age requirements and that the event host is responsible for age verification on site.
3. Quotes, estimates, and bookings
- Online cost estimates are approximate, based on the inputs provided, and exclude travel outside quoted areas unless stated.
- A booking is confirmed only when we accept it in writing (including email) and any required deposit is received.
- Prices are generally listed before Harmonized Sales Tax (HST) unless we state otherwise. Applicable taxes will be added to invoices.
- Final pricing may change if event details, location, timing, guest count, or add-ons change after the quote.
4. Deposits, payment, and cancellation
- Deposits and payment schedules will be set out in your quote or booking confirmation.
- Deposits may be non-refundable once paid, except where required by law or as we agree in writing.
- If you cancel or significantly change an event, fees may apply based on notice period and costs already incurred (staffing, product, travel, custom work).
- If we must cancel due to circumstances beyond our reasonable control, we will work with you in good faith on a reschedule or refund of recoverable amounts.
5. Client responsibilities
You agree to:
- Provide accurate event details and a suitable, safe service location
- Obtain any venue permissions required for hookah service
- Ensure compliance with venue rules, local by-laws, and fire safety requirements
- Provide reasonable access for setup, service, and takedown
- Prevent underage use and misuse of equipment; follow staff guidance on safe operation
6. Health, safety, and hygiene
We use professional equipment and hygiene practices as part of our service standards. Hookah use involves inherent risks. Guests participate voluntarily. Oui Smoke is not responsible for adverse health effects arising from guest use of hookah products, except to the extent caused by our gross negligence or willful misconduct as determined under applicable law.
7. Website use
- You may use the site for lawful, personal, or internal business purposes only.
- You may not attempt to disrupt the site, scrape content at scale, or misuse forms or calculators.
- All trademarks, logos, photos, and content on this site are owned by Oui Smoke or our licensors and may not be copied without permission.
8. Disclaimer
The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by Ontario and Canadian law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the website. We do not warrant uninterrupted or error-free access.
9. Limitation of liability
To the fullest extent permitted by law, Oui Smoke’s total liability arising out of or related to website use or a booking is limited to the amount you paid us for the specific event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, even if advised of the possibility. Some limitations may not apply where prohibited by consumer protection law.
10. Indemnity
You agree to indemnify and hold harmless Oui Smoke and our directors, officers, employees, and contractors from claims arising out of your breach of these Terms, unsafe or unauthorized use of equipment, underage access, or your failure to secure required venue approvals, except to the extent caused by our gross negligence or willful misconduct.
11. Privacy
Personal information is handled as described in our Privacy Policy.
12. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site after changes constitutes acceptance of the updated Terms. Confirmed bookings remain subject to the written booking terms in effect for that event.
